Yes, there is a difference between legally permitted, and common courtesy.
From what I can gather, a blanket license, which I assume was in place, would probably fall under the legally permitted category.
But 'normally', people would respect a request out of common courtesy or because they would like to avoid further scandal, damage to reputation, etc.
HeWhoCannot amed does not operate in the land of 'normal' though.
1. He is lawyer'ed up to the n-th degree and they are hard-nosed as hell. So, even if there were a legal case for the other side, his lawyers would drag things out endlessly, counter-sue, spread rumors or blame around, and do whatever they can to make HeWhoCannot amed win. They also aggressively persue anyone saying anything against HeWhoCannot amed. I.e. NBC aired today that they cannot say anymore that Ivanka's speech was plagiarized, so now they say things like ' it has been said that she plagiarized'...What that means is, that msnbc has received threatening phone calls that they would get sued by HeWhoCannot amed for their reporting, that is how aggressive these HeWhoCannot amed lawyers are.
2. HeWhoCannot amed does not give a darn about that law-abiding part of his image, he uses the law to suit his agenda. He will plagiarize again and again, because the more he does it, the more it becomes the new normal. He will also use this song again, because he knows now that it annoys Queen, as well as the media, and he wants to present himself as strong, above the law, and as a 'rebel', because this is what his voter base wants in their 'chosen hero'.
He does not give a flying fig about some people here being annoyed. He very well knows they will not vote for him anyway (as presumably does most of the fanbase here).
3. You read about other cases, where politicians or public figures have settled with artists?
For one, was the situation was really comparable? And secondly, did that public figure just have much more fear about a public backlash than HeWhoCannot amed ever has. They may have settled just to get the story out of the public's eye, not because they legally and technically had no rights in the matter. HeWhoCannot amed may be legally safe here.
4. HeWhoCannot amed has created new 'normal' in many areas of the law. He is not being sued for slander, though tons of his statements could potentially qualify, he is not held liable for instigating violence, even though he clearly did. He is not called out for lies, even though they are on video, and he clearly has gotten away with tons of stuff in the past, that most ordinary people would not get away with, not to speak of public figures. He has clearly stated his intention to seek out 'the right' justices if elected. So expect the American legal system to be permanently altered, should he win and win big (i.e. have congress to work with).
5. Brian has been quite careful in his tweets to just request that the songs not be played, not more. He knows that he needs to appeal to common practices of courtesy, rather that the letter of the law. In the end, if HeWhoCannot amed loses in November, the use of the song will echo in our memory, but otherwise it blows over over. If HeWhoCannot amed wins, the country and the world will have bigger problems than the use of a song, tbh.
In my opinion, this battle cannot be fought legally. This battle needs to be fought via public image. By letting the man, who HeWhoCannot amed thinks cannot defend himself anymore (Freddie) do the talking. Use the media's willingness to cover this story to throw some major shade at HeWhoCannot amed. If HeWhoCannot amed wants to hear Freddie lyrics, let him have some.
