More plain English from ScotusBlog on the DOMA case and what it means: The federal Defense of Marriage Act defines "marriage," for purposes of over a thousand federal laws and programs, as a union between a man and a woman only. Today the Court ruled, by a vote of five to four, in an opinion by Justice Kennedy, that the law is unconstitutional. The Court explained that the states have long had the responsibility of regulating and defining marriage, and some states have opted to allow same-sex couples to marry to give them the protection and dignity associated with marriage. By denying recognition to same-sex couples who are legally married, federal law discriminates against them to express disapproval of state-sanctioned same-sex marriage. This decision means that same-sex couples who are legally married must now be treated the same under federal law as married opposite-sex couples.

Committed same-sex couples who are legally married in their own states can now receive federal protections - like Social Security, veterans' benefits, health insurance and retirement savings. Prop 8/Hollingsworth v. PerryVictory! Proposition 8 has been struck down! The Supreme Court denied standing for the proponents of Proposition 8. This ruling will revert to the ninth circuit court, which will overturn Proposition 8. This means that committed same-sex couples in California will soon be able to marry their loved ones once again.

For this politics watcher, this has been one of the best mornings in a long time. Not only is DOMA struck down and Prop 8 deemed unconstitutional, but at least for today the historic filibuster by Wendy Davis to prevent enactment of SSB5 was successful with the loud and raucous intervention of the gallery. If there is one thing Texans are good at, it is being loud and raucous. It was down to minutes.

Junie, do we know yet if this affects marriage/citizenship/domicile issues with foreign nationals? It is my understanding that any specific support for the rights of same-sex couples was dropped from the pending immigration bill. However, this ruling forces the federal government to treat legal same-sex marriages the same as opposite-sex marriages. So if the foreign national is legally married to the American, they have to be treated the same. If not, then the relationship still has no legal standing.

Just have to say how happy I am about the strikedown of DOMA! Still a lot of progress to be made. Marriage Equality is not legal in my state (PA) and may not be for a long time.
