More plain English from ScotusBlog on the DOMA case and what it means: The federal Defense of Marriage Act defines "marriage," for purposes of over a thousand federal laws and programs, as a union between a man and a woman only. Today the Court ruled, by a vote of five to four, in an opinion by Justice Kennedy, that the law is unconstitutional. The Court explained that the states have long had the responsibility of regulating and defining marriage, and some states have opted to allow same-sex couples to marry to give them the protection and dignity associated with marriage. By denying recognition to same-sex couples who are legally married, federal law discriminates against them to express disapproval of state-sanctioned same-sex marriage. This decision means that same-sex couples who are legally married must now be treated the same under federal law as married opposite-sex couples.
Junie, do we know yet if this affects marriage/citizenship/domicile issues with foreign nationals? I just heard on NPR that this would effect those couple living in states that have safe sex marriage. What a patchwork of rights this is creating.

[smiles] This is really a historic day for many reasons, not just for California. I know Adam and Sauli are no longer dating, but this court case also affects bi-national couples who marry. As stated by the Washington Post: "This opens the doors to bi-national same-sex couples to be treated equally under the law...." The court did not rule today on whether states have to recognize same-sex marriages performed in other states. That question will have to wait for another case and another day.

For this politics watcher, this has been one of the best mornings in a long time. Not only is DOMA struck down and Prop 8 deemed unconstitutional, but at least for today the historic filibuster by Wendy Davis to prevent enactment of SSB5 was successful with the loud and raucous intervention of the gallery. If there is one thing Texans are good at, it is being loud and raucous. It was down to minutes. Yay for you guys. I watched a bit of the live stream last night after someone posted it.

This is just as moving as when we voted in our first African American president and black parents said they could, for the first time, honestly tell their children that they can be anything they want when they grow up.
