Out of curiosity I asked my son, who's a lawyer, what this lawsuit could mean. Without all the details, he could only speculate that Sony & Adam stopped the sale of BFM on Amazon with a writ saying that Welsford was infringing on their rights by contract with Adam...The lawsuit is saying that they owned the rights to just these songs by contract before AI, therefore if Adam misled AI, it was his fault, not theirs. Hence, the reference to the AI contract. They also threw in the Spacebook, for shits & giggles. He also said they are not going after Monte because he honored the contract, did not put a stop to it, and doesn't have a pot to piss in (money). Monte has shown that he couldn't do anything about it because he signed a contract... It's because Adam stopped the sale, along with Sony, that they're suing him...don't blame Monte, he thank Welsford for helping with his new CD...not for the old contract. Actually, I have talked to a couple of Copyright (IP) and Entertainment Law Attorneys -- they also say that no one can be sure about the claim and the validity of the claim without reviewing the filings and the contacts BUT.... 1. The Idol claim has no bearing on this case. It is there to get press. 2. The MySpace copyright infringement is trivial. A joke. 3. T here is NO information that Sony or RCA had anything to do with the "takedown" order that Amazon received. From the filing: "Upon information and belief, Lambert, through his authorized agent and representative, knowingly materially misrepresented to Amazon.com in the 'takedown notice' that Amazon's promotion and sale of the Album infringe Lambert's rights. Note: Welsford and his "agents" have privately made the claim that RCA and 19 stopped this release, but that is NOT in this filing.Welsford had a contract with Adam. He wants to release this album that he recorded and produced. Why all the other stuff? Why sling the crap about Idol? There must be more to this than we know because if it was a clean contract for an album by Adam Lambert it would have been released in November 2009 -- like Take One. I BELIEVE (but do not know) that what changed in this is Monte's position. Nothing else makes sense with everything we know. There are many ways to make money -- but if you choose to lie with SNAKES and SLUGS to earn a buck -- you cannot continue to live with the eagles. Too bad that we can't go back in a time machine, put these songs on Take One, and have this whole thing would have been over 2 years ago. JMHO IMCMWD (I am certain many will disagree.) |

HAPPY BIRTHDAY MAMADEB and WILDFLOWER I feel so lucky.....last night I met my best friend to go to our 1st xmas open house! can you believe it? Well a light bulb went off in my head. SHe and I met ages ago when I lived in Center City. We met through our pets. I lived on the 3rd floor and she on the 1st fl apt. Our cats (I had cats then) escaped into the hall so we were always chasing them. 30+ yrs later we are still friends. Well living in the city, you encounter all types of people as I was in theater a lot of my friends were gay. My best friend from the dance co who was gay, died of aids, but had choreographed Jane Fonda - remember her?- he choreographed her exercise video. well to make a long story short My girlfriend and I was talking, and an idea clicked..we know friends in the gay community. Now tell me why I didn't think of this earlier, I don't know. But I made a call, a behold, one of them has a subscription. I getting the Adam issue in Advocate. I told him not to mess up the cover. LOL. I'm so excited and now getting way too excited for tomorrow. What a great weekend this is turning out to be! ps He will visit a few magazine shops who geared to gays and looked to see if there might be copies there. IF so, he'll pick them up so I'll let you know if we are successful. Doubt it, but it's worth a try :  |

Being a bit of a word nerd, this jumped out at me: • The plaintiff also is seeking declaratory relief that it owns a 50% publishing share of the recordings, that it has an unconditional right to promote and sell the recordings, that neither the Music Services Agreement nor the Co-Publishing Agreement was validly rescinded, and that these agreements remain in effect. Why did that word need to be there? Does it imply that Adam really thought he had finished with this 'contract' but they've 'found' a little 'loophole', or is it just me, as usual, reading too much into other's words :-/ That one word indicates that there is a claim of a subsequent agreement -- either a written or verbal agreement. We really do not know all the facts and we certainly do not know all of the claims. |

I hope a friendship hasn't been compromised beyond repair. I think back on the look that Monte and Adam exchanged just before he started singing "Outlaws of Love" in Montreal. It seemed to me they were both really excited to bring that moment to the fans. I hope they can recapture that mutual respect and friendship. If I could figure out how to load a screencap to photobucket I'd go look it up and post it. |

I think some Adam fans do not care about reality...Don't be surprised if this might come back to bite them in the butt...I repeat, where does Monte support this bastard cd? With huge apologies to Gelly who wanted this taken elsewhere, I have waited a couple of hours but can't let this slide without saying my piece. I think it is fair to say that for most of us that have been stalking, following, adoring Adam for the past almost three years (OMG, is it that long??!!), the one thing that I think we have learned is that Adam seems like a great person. Loves and pimps his friends, acquaintances and other artists. For me, the type of friend I could only dream of finding. I think it is also safe to say that starting back at Lisa's twitter rant, it was obvious that there were hard feelings and then there were all of these "unfollows" which made it more obvious to me that Adam has been hurt by someone he considered a friend. For me, and maybe for others.....that is all I need to know. Nothing will bite me in the butt.....because to me (and YMMV, IMHO and all that) Adam is the better person and will always come out ahead, no matter what the issue and no matter what the outcome.....that is what being a good person does for you. Mods feel free to delete if necessary.....just feels good to get it out.
And now on to the EMA's !!!!!!!! WOOHOO!!!! I am so EXCITE!!!!!! |
