Trying to figure out the final determination will only give you a headache. I have 3 attorneys in the family who agree with me when I say the law is fluid, it is not always fair, and it is open to the interpretation of the judge. What SHOULD be is not always the case, but if you get a thorough, conscientious judge, the bullshit is dispensed with and intent becomes the primary concern. We all know what the intent is. Unfortunately, according to what was posted a few days ago, the judge apparently has a reputation for being a self-absorbed tool who looks for the easiest conclusion that best strokes his own ego. This kind of goes in the "law is fluid" category mentioned by ccsnow, but if a judge has a specific known character that knowledge can be used by a good lawyer to facilitate a desired outcome and it sounds like Adam's lawyer is a good one. It is not always just about the merits alone but about the presentation.

While I agree with Juniemoon that We Are the Champions and We Will Rock You are stadium staples, I have to tell you that my 6 yr old granddaughter recognized them immediately as i played them more than once yesterday and said her teacher plays them in gym class. I have to meet that teacher while I'm here. Oh, believe me. The youngest kids know We Will Rock You. In music classes if I clap the famous drum rhythm from that song (short, short, long), some little one recognizes it. Then a spontaneous group performance of the rhythm erupts and I have become irrelevant. :D Never fails. Plus 4th and 5th grade band students want to play it as a solo. They all know it--and I did not teach it to them. I'm quoting myself from this morning about little kids knowing We Will Rock You. I have no idea what topic I am interrupting. So today I had 1st graders repeat back to me the WWRY drum rhythm by patting the legs for the two short beats and clapping on the long one. (I didn't say anything about the song. It was just one of many rhythms we clapped.) The effect is a sound that is "low low high" as heard in the song. It only took a couple repetitions before I heard one little boy (normally quite spacey) start singing quietly "We will rock you." Then a whole bunch of the kids recognized it. As predicted singing and pat-pat-claps ensued.
