What is MJ ??? Did anyone answer you yet bb? "mj" stands for mjsbigblog.com, the site where many of us watching American Idol during the actual season Adam was competing first met. Its an American Idol blog site, not a fansite of any particular contestant. Plus, mj habitually seemed to (in the past) encourage the exodus of as as many fans as possible after a season was over to make room for the new season. Her moderating can be a bit...extreme...at times. Particuarly if people get too gushy. Hence, a large group of us left to form Planet Fierce. PF was run by Rowe, with Q3 as her wingman. When some of the print media jackals were starting to sue blog owners over copyright issues, Rowe got scared and shut down PF without warning. Q3 then set up Adamtopia, and told peeps who had scattered to Twitter or to AFL about the new site. Adamtopia has changed board servers and formatting, and added many wonderful new members. However, many of the "old-timers" have been part of the same group going back to mj's. [laugh] Which is why when someone like hwc, anthrogeek, or janusaquarius show up, a lot of us get excited. They go back a ways with many of us who started off with them on mj's and Adam's American Idol tour and we miss them. :D And THAT'S probably far more history than you were expecting bobo!! ;D

LOL to be honest, he didn't even cross my mind. I have to admit I thought about it alot and only because I care about Adam's happiness not Monte's. This must hurt him alot. Specially because of the long friendship they've shared and the fabulous year they all shared together on the road! This really sucks!!!! :( And again we are assuming that because there was no tweet that he didn't contact Adam - I am pretty sure he has his phone number... but again why do I care. Oh that's right I don't ;D

Thanks guys for the information on Tommy and the Grammy's. I guess Issac and Cam will play with Adam again, too, if they don't have other commitments. Wonder what Adam's band will look like? He'll need a new lead guitarist, too. Hopefully most of the dancers will be back and maybe he'll be able to add some backup singers this time. Well...let's just get the SINGLE out first and then the album! ;D The rest will all fall in place.

I just read the Queen performance thread again. So much fun! It reminds me of the Grammy Nom thread when we first discovered that he got a nomination. Does anyone have the macro that someone posted a few days ago of a pic from the Queen performance and over it, it says something like, "Your argument is invalid because Adam just sang with Queen?"

Monte isn't mentioned at all in the lawsuit. Monte said in his letter he and Adam sold their rights to the songs long ago. He and Steve Cooke talk of being paid well.
How does Monte fit into the lawsuit? Is there anything to indicate Adam still owns his portion? I don't consider this well paid. It seems almost slave labor for someone of Adam's caliber of voice. Can we tell from the pay if these were demos or actual recordings (He would be paid $50 for final product)?
The contract seems to back up what Adam has said IMO. This wasn't a star making recording contract. It did seem like session work. The early part of the contract even indicates Adam was paid as a session singer. The meager amounts show how much of a struggling artist he was.
Note: 2006 was when Adam had quit Wicked touring company and working in "Debbie Does Dallas". $2,500 would have been a great deal of money. It also shows a long term relationship with Adam. They new him from 2006 and didn't see his star potential?
Fonzerelli and J. Scott G both said Adam terminated all working relationships with them to go on idol. Would he be careless enough to overlook Wilshire?

Hi Everyone,
I'm coming out of my typical lurkerdom to comment on the Colwel Platinum lawsuit. I'm an attorney, but not an intellectual property attorney, nor am I familiar with California contract or tort law. That being said, I agree with those who said this lawsuit has nothing to do with Adam's involvement with Idol or his MySpace posts. This is all about the takedown notice Adam sent to Amazon. Essentially, Colwell wants two things: 1) damages it suffered as a result of the takedown notice and 2) a judgment by the Court declaring that it has the right to publish, promote, etc., the specific tracks at issue. The issue seems to turn on whether Adam validly rescinded the Music Services Agreement and Co-Publisher Agreement with Welsford in June, 2009. Interestingly, and someone please correct me if I'm wrong, wasn't June, 2009, when this whole mess first surfaced. And didn't Welsford initially plan to release these songs which Adam co-wrote, but then ended up only publishing the Take One demos? If so, I would suspect that whatever Adam did in June 2009 was done upon advice of counsel and with the blessing of RCA.
Whether Adam validly rescinded the contracts will likely turn on whether the language in the Co-Publishing Agreement that limits Adam's damages for breach to an action for damages is enforceable under California law and whether he was due money under the Co-Publishing Agreement at the time of recission. I'm interested to hear about the allegd 2006 loan from Coldwater Entertainment Limited. What, or more importantly, who is Coldwater Entertainment Limited? Did Adam's relationship with Welsford or even Monte go back that far? The Complaint did not provide much detail about the alleged loan or any agreement as to how it was to be paid back. I'd have to read the Co-Publishing and Music Services Agreement closer to see if they allow the setoffs of this alleged loan as Colwell suggests.
To answer a question posed earlier, this lawsuit does not seem to seek any rights with regard to FYE or future recordings or compositions. While the contract language on its face appears to give Colwell that right, not everything in a contract is necessarily enforceable. Again, while I don't practice in this area and am not familiar with these types of agreements specifically, I would guess that this is similar to a non-compete clause in an employyment agreement, which courts will enforce, but only if reasonable.
That being said, this lawsuit is probably not a big deal. We live in a litigious society and the more successful you are, the more likely you are a deep pocket. Also, this is not the first, nor the last time a business relationship (even between friends) has gone south and ended up in Court. And there is definitely an upside. It is now more obvious that Adam doesn't support this album and that, even if they use his name and his image, this is not his new music.

kittykay, Steve Cook is not a part of the Beg For Mercy mess. He is only in the Paramount Sessions which are recordings that Adam did as demos. The exact same songs on Take One being rereleased. Steve is confused when he tweets about the lawsuit. LOL! Thank you, TwoTrue! Glad you delurked. I can answer one of your questions, "Yes" Adam and Monte go back that far. They worked in The Zodiac Show together. They go all the way back to at least Dec. of 2004!

Don't throw rocks at me, but I'm hoping Adam up-hauls everyone and get a whole brand new band, maybe he can keep Tommy and move him to rhythm guitar but I want new people. Even though I've liked Cam's and Isaac's looks, and how they fit with Adam's aesthetic, but their playing and improv left a little to be desired imo. I don't know. After listening to The Show Must Go On after a gazillion times, then going back and listening to my old GNT/Pre-Idol/Post-Idol faves, Adam still sounded amazing but the band....I mean I know that the composition and instrumentation of Queen is unbelievable, but listening to Adam's band playing, they just seemed to be sort of lacking. Other then Zac and Longineau, the others just doesn't do it for me. Never really have been too impressed with any of the others playing, besides those two. I think I just want Adam to have a band that will be well matched to what he can do vocally that's all. And I'm sorry Bobo for not answering your question earlier. I meant too, then totally forgot.
