English is not my language, I need clear audio in a video, dammit. it annoys me too and I know English really good lol Me too!! It was driving me nuts for a bit there; it was competing with him and added nothing. Use it as a transition, fine, but don't make him have to talk over his own music. There was a term used in one of the reports that I looked up because I'd never heard of it in the 'positive' before: Dismissal with Prejudice A dismissal with prejudice is a judgment rendered in a lawsuit on its merits that prevents the plaintiff from bringing the same lawsuit against the same defendant in the future. It is a harsh remedy that has the effect of canceling the action so that it can never again be commenced. A dismissal with prejudice is Res Judicata as to every issue litigated in the action. The possibility of such a dismissal acts as a deterrent to the use of dilatory tactics by a plaintiff who wants to prejudice a defendant's case by unreasonably hindering the disposition of the action from the time of the filing of the action to the actual trial of the issues. It is also designed to minimize, if not eliminate, the congestion of court calendars caused by unnecessary delays in pending cases. Because it is regarded as a drastic remedy, courts grant dismissals with prejudice only in the most egregious cases in response to a motion brought by a defendant or by a court sua sponte or on its own will. Obviously lots more to know, for me primarily, will BFM still be labelled up in the same way??? ETA: Meaning of egregious (adjective) conspicuously and outrageously bad or reprehensible; flagrant; glaring; gross; rank. I'd agree with that I think. When a lawsuit is settled prior to trial the parties usually agree that the Plaintiff will file a Voluntary Dismissal. They do it either with or without prejudice but most of the time it is with Prejudice because the parties have reached a satisfactory conclusion and the Defendant would want to ensure that later down the road the Plaintiff can not file another suit reopening the same litigation. This isn't unusual in litigation cases and isn't a "punishment" of the Plaintiff for egregious actions. It means the matter was resolved by the parties and the case is being dismissed and can not be filed again at a later date. It is usually done after the settlement agreement is signed and put into the court record. Sometimes when there is contingency stipulations that must be met at a later date the Plaintiff will file a Voluntary Dismissal without Prejudice which allows them to refile should the defendant not meet their obligations of the settlement. I would guess that Colwel wanted the right to release the music without interference from Adam (and probably without paying him) and in exchange he had to repackage the album as Pre-idol music AND expressly retract the claim that Adam wasn't eligible to compete on Idol. Likely Adam and his lawyers didn't care about the actual release of the album as they saw that Take One had no real impact and mainly wanted the blatant false claim that is was "new music" stopped. They also probably wanted to clear Adam's name insomuch as Colwel tried to impugn his integrity by claiming he had somehow entered Idol under false pretense by lying about his eligibility. *sorry for the long post I work in the legal field and wanted to clarify for those who are interested. eta: typed this up as Q3 was saying just stick to news. Guys I am bringing my question I posted in number over here so maybe I can get some thoughts.
I listen to Z every morning and this morning I heard them spin--and not sure if it was just online or what--Elie Goulding's 'Lights' and said it was "new music". This is the FIRST time I have heard them do this. Now I know the song has been out for a while and is very close to Adam on the charts right? Wasn't there discussion the other day about if it was going recurrent or not? So def NOT new, though they could have meant new music to Z. And someone told me on Twitter that Z never added so wondering what this all means in respect to BTIKM.
They are pretty close on the charts no? Soooo does this look good like maybe Z will start playing if not add? Or is it just Interscope throwing around some money per usual....????

WOW!!!! So excited...just got tickets for i93 Dallas show with Adam on Monday. I've never won anything and this is the best "win" ever. So proud of ATOP and the charity:water drive. This is the best, most generous group of people anywhere. Adam's light and love is reinforced through his fans here. OMG!!!! Barb i'm so happy for you!!! Can't wait to hear all about it. |

Good morning! I woke up to the great feeling of knowing our 'little ole' Leap Day challenge is helping more children and adults get the fresh water they so need to live healthier and happier lives. I was listening to Mix 96.1/KiddKradick(sp) in the morning in the car, and Kidd just said Adam Lambert will be joining them on Tuesday!! kiddnation.com/kiddtv/ is showing BTIKM music video and it said, "Adam Joins Us in Studio Tuesday" !! I wish I live in Dallas!!  |
