I c/p the whole article so you don't have to give Perez hits.

Angry Music Fan Sues Apple For iTheft
We thought the customer was always right?!
Apparently Apple feels differently.
Robert Herskowitz is no happy camper after being double billed for one Adam Lambert song!
Apple-owned iTunes refuses to refund the extra $1.29 it charged him for downloading Lambert’s Grammy-nominated track Whatya Want From Me? but now the company's stinginess might come back to bite them in the asspple.
Robert filed a class-action lawsuit on behalf of all similarly wronged parties and laid out his grievance pretty clearly:
"[Apple] 'double billed' customers for purchases made through the Apple Stores. Even more troubling, Apple has implemented a policy and practice of refusing to refund the extra charge to customers who have been over billed, causing their credit cards or PayPal accounts to be billed twice for a single purchase."
Times are tough for the music industry these days, but we hardly think ripping off customers a few dollars at a time is helpful.
Apple maintains that Herskowitz is simply "ineligible" for a refund. In a statement, the company said:
"Your request for a refund for Whataya Want from Me was carefully considered; however, according to the iTunes Store Terms of Sale, all purchases made on the iTunes Store are ineligible for refund. This policy matches Apple's refund policies and provides protection for copyrighted materials."
We don’t know whether this lawsuit has a snowball’s chance of reaching any sort of cash settlement, but at least it brings much needed attention to Apple’s inflexible policies and growing customer dissatisfaction.
Would Steve Jobs have let it come to this?
He's probably rolling over in his all-white aluminum coffin while the current Powers That Be shrug their shoulders and say Whataya Want From Us?
Maybe they really SHOULD put Ashton Kutcher in charge, LOLz!!
